Privacy Policy of W5YI-VEC

W5YI-VEC has adopted this privacy policy to comply with Texas Business and Commerce Code section 35.581.  W5YI-VEC maintains under this privacy policy the confidentiality and security of a social security number disclosed to W5YI-VEC. The phrases "personal information" and "personal identifying information" have the same meaning as they do under Chapter 35 of the Texas Business and Commerce Code or any successor statute.

1. How Personal Information Is Collected

Personal information is collected directly from the individual to whom it pertains, or indirectly through a volunteer examiner who sends the personal information to W5YI-VEC, by means of one or more of the following (all relating to amateur radio licenses granted by the Federal Communications Commission): license applications, modifications, renewals etc. (collectively, Applications)

2. How And When The Personal Information Is Used

The personal information is required by the Federal Communications Commission (the FCC) to be sent to it in connection with the processing of Applications. It is not otherwise used by W5YI-VEC, except W5YI-VEC may be legally required to provide the personal information to governmental authorities or in connection with legal proceedings. Furthermore, W5YI-VEC will cooperate with law enforcement agencies in identifying those who act unlawfully in connection with the amateur radio licensing process.

The personal information is used from the time it is obtained until at least the expiration of the period during which the FCC requires W5YI-VEC to retain the personal information. Thereafter, personal information in paper form is disposed and personal information in electronic format is retained indefinitely. However, retained personal information is generally not used in any manner other than to respond to inquiries of the FCC.

3.How The Personal Information Is Protected

The personal information is protected by certain procedures of W5YI-VEC, including but not limited to the following: (a) storing the personal information in areas in which only trusted persons or others monitored by trusted persons are allowed access and (b) instructing trusted persons to take care that when the personal information is communicated by telephone, facsimile, email or other means, it is directed to the proper person or entity. Additionally, W5YI-VEC maintains electronic safeguards to protect personal information stored on computers.

4.Who Has Access To The Personal Information

Officers, directors and certain contractors (and their employees) of W5YI-VEC, as well as the FCC, are allowed access to the personal information.

5.How The Personal Information Is Disposed.

When W5YI-VEC disposes of a business record that contains personal identifying information of a person supplying same in connection with Applications, W5YI-VEC will modify, by shredding, erasing or other means, the personal identifying information to make it unreadable or undecipherable or will contract with a person engaged in the business of disposing of records for the modification of personal identifying information on its behalf in the same manner.

W5YI Group respects the privacy concerns of the visitors to its Web Sites. As a general policy, no personal information is automatically collected from visitors to its sites. E-mail addresses and other personally identifiable data about visitors to this site are known to W5YI Group only when voluntarily submitted.

However, certain non-personal information of visitors (e.g., the type of browser being used by the visitor, the type of operating system in use by the visitor and the domain name of the visitor's Internet service provider) is recorded by the standard operation of W5YI Group's internet servers. This information is primarily used for internal review of the number of visitors to the sites but only in an aggregate and non-personally-identifiable form. This information will be kept private and will not extend to any entity outside of W5YI Group employees and associates. Personally identifiable information may be collected by W5YI Group when Web Site visitors voluntarily buy items from the online store, apply for a license renewal, or other form areas of the website. All such personal information is retained by W5YI Group and is not sold or otherwise transferred outside the company unless we obtain your express consent to do so or if we are required by law or by court/governmental order to disclose such information in a particular circumstance. This information is used by W5YI Group for internal marketing and promotional purposes, in order to better understand the use of our sites and to support promotions included on these sites, as well as to enhance user enjoyment during the on-line experience. However, this data, in non-personally-identifying form, may be provided to other parties for marketing, advertising or other uses. We sometimes also use e-mail addresses and other personally identifiable information to contact visitors who communicate with us.
